In 2025, Spanish tenants are facing a dramatic shift in rental conditions due to a lesser-known provision buried within a 2020 reform of the Ley de Arrendamientos Urbanos (LAU). While initially presented as tenant-friendly legislation, the five-year minimum lease terms established in 2020 are now expiring, opening the door for landlords to significantly increase rents or refuse lease renewals without cause. This legal change affects an estimated 300,000 to 500,000 tenants, who could be evicted or subjected to steep rent hikes with little warning.

Under the current law, landlords are not obligated to renew leases once the five-year term concludes, nor do they need to provide justification or advance notice. For tenants who do receive lease renewals, rent increases are largely unrestricted outside designated price-controlled zones, leading to soaring rents in many areas. For example, the Balearic Islands have seen rental rates surge nearly 48% since 2020, with other cities experiencing hikes of 20–40%, forcing tenants to pay hundreds more monthly for the same living space.

Despite government efforts to introduce rent controls and extend contract durations, landlords argue for property rights and the necessity to manage their investments amid the risks posed by difficult tenants. Meanwhile, tenants face an uncertain housing market, with protections limited and many left vulnerable to eviction or unaffordable rent increases.

This complex situation creates tension between the interests of landlords seeking fair returns and tenants desiring housing stability. For landlords, understanding these 2025 legal realities is crucial to navigating lease expirations, rental negotiations, and compliance with evolving regulations.
